Terms and Conditions

Nightrush Corp ("Nightrush," "we," "us," or "our") provides a hospitality marketplace and related products and services, including our website, mobile applications, directories, communications, booking and staffing tools, verification tools, support channels, and AI-assisted features (collectively, the "Services").


This Privacy Policy explains how we collect, use, disclose, store, and protect personal information when you visit our website, create an account, use the Services, request or offer hospitality-related services, communicate with us, or otherwise interact with Nightrush.


We are committed to data minimization, purpose limitation, and protecting personal information with reasonable administrative, technical, and physical safeguards. We collect only the information we reasonably need to provide and improve the Services, comply with law, protect users, and operate our business.


1. Scope

This Privacy Policy applies to personal information we collect through:


  • our websites and mobile applications;
  • account registration, onboarding, verification, and profile creation;
  • bookings, staffing, supplier and buyer matching, and related transactions;
  • customer support, communications, and marketing interactions;
  • AI-assisted search, recommendations, and support features; and
  • any other online or offline interaction that links to this Privacy Policy.

If you provide personal information to another user or third party through the Services, that party may separately process the information you share with them. Their practices are governed by their own privacy policies and agreements.


2. Personal Information We Collect

We may collect the following categories of personal information:


A. Information you provide directly

  • Identity and contact information: name, email address, phone number, postal address, company or venue name, and similar identifiers.
  • Account and profile information: username, password, profile photo, biography, hospitality role, years of experience, availability, service offerings, certifications, social links, and preferences.
  • Booking and transaction information: requests, bookings, schedules, staffing details, event details, venue information, invoices, payout details, and payment-related information processed through our payment partners.
  • Verification and trust information: government-issued identification, selfie or profile verification information, background-check authorizations or results, work eligibility information, and health or safety certifications where required by law or a client engagement.
  • Communications and support information: messages sent through the Services, support tickets, survey responses, waitlist submissions, and other information you choose to provide.
  • Marketing preferences: your communication preferences, opt-ins, opt-outs, and consents.

B. Information collected automatically

When you use the Services, we may automatically collect:


  • device and browser type;
  • IP address and approximate location derived from IP;
  • operating system, app version, device identifiers, and crash diagnostics;
  • log data, timestamps, pages viewed, links clicked, and referral URLs;
  • cookie identifiers and similar technologies; and
  • usage, performance, and security information.

C. Information from third parties

We may receive information from:


  • authentication providers such as Google when you choose social sign-in;
  • app stores such as Apple and Google;
  • payment processors and payout providers;
  • background-check, identity verification, fraud prevention, and safety providers;
  • analytics and infrastructure providers;
  • customers, venues, suppliers, and referral partners; and
  • public or commercial sources, where permitted by law.

D. Sensitive information

Some information we collect may be considered sensitive under certain laws, such as government ID data, background-check information, or health/safety certifications. We collect and use sensitive information only where reasonably necessary, legally permitted, and proportionate to the Services we provide.


3. How We Use Personal Information

We may use personal information to:


  • create, maintain, and secure user accounts;
  • verify identity, eligibility, safety, and trustworthiness;
  • match buyers, suppliers, staff, venues, and service providers;
  • facilitate bookings, scheduling, customer service, payments, and payouts;
  • send service-related messages, security alerts, and account notices;
  • respond to support requests and communicate with users;
  • personalize and improve the Services, including search, recommendations, and operational tools;
  • measure usage, performance, quality, and effectiveness of the Services;
  • detect, investigate, and prevent fraud, abuse, harassment, security incidents, and other misuse;
  • comply with applicable laws, regulations, legal process, and contractual obligations; and
  • send marketing or promotional communications only where permitted by law and, where required, with appropriate consent.

We do not use government IDs, background-check information, payment card information, or SMS consent records for unrelated advertising or promotional profiling.


4. Legal Bases for Processing

If you are located in a jurisdiction that requires a legal basis for processing, we process personal information on one or more of the following grounds:


  • Contractual necessity: to provide the Services you request and perform our agreement with you;
  • Legitimate interests: to operate, improve, secure, and support the Services, provided those interests are not overridden by your rights;
  • Consent: where we ask for and receive your consent, including for certain marketing, cookies, or sensitive-data processing;
  • Legal obligation: to comply with laws, regulations, court orders, subpoenas, tax obligations, and similar requirements; and
  • Protection of vital interests: in limited circumstances involving health, safety, or fraud prevention.

5. Text Messaging, Phone Numbers, and Mobile Privacy

If you provide a mobile phone number to Nightrush, we may use it to send you:


  • one-time passcodes or verification messages;
  • account security alerts;
  • transactional or operational messages related to your account, bookings, staffing, schedules, support, or service updates; and
  • marketing or promotional messages only if you separately opt in.

Message frequency varies depending on your activity and preferences. Message and data rates may apply.


You may opt out of recurring text messages at any time by replying STOP. You may request help by replying HELP. If messages are sent from a U.S. toll-free number, START or UNSTOP may be required to opt back in after opting out.


Consent to receive marketing texts is not a condition of purchase or use of the Services. If you request a one-time verification code or other account-security message, we will use your phone number to send the code or notice you requested.


We keep records of consent, opt-in, opt-out, and related messaging preferences as necessary to comply with law, prevent abuse, and resolve disputes.


No mobile information will be shared with third parties or affiliates for their marketing or promotional purposes. Text messaging originator opt-in data and consent will not be sold, rented, or shared with any third parties except with service providers, carriers, platform providers, or subcontractors that help us deliver text messages or comply with law.


We do not publicly display your private mobile number on your public profile by default.


Carriers are not liable for delayed or undelivered messages.


6. How We Disclose Personal Information

We may disclose personal information in the following circumstances:


A. Service providers and processors

We may disclose information to vendors that perform services on our behalf, such as:


  • hosting and cloud infrastructure providers;
  • website and application platform providers;
  • customer support and CRM providers;
  • communications providers, including email, in-app messaging, and SMS providers;
  • payment processors and payout vendors;
  • background-check, identity verification, fraud prevention, and safety vendors;
  • analytics, diagnostics, and security providers; and
  • authentication and login providers.

These providers may include, where used by Nightrush, services such as Webflow, AWS, Intercom, Stripe, Checkr, Google, Twilio, and similar providers. We require service providers to process personal information only for authorized purposes and subject to appropriate confidentiality and security obligations.


B. Other users and transaction counterparties

If you use the marketplace, some profile, booking, and service information may be visible to venues, buyers, suppliers, staff, or other transaction participants as needed to facilitate the Services. We limit disclosure of private contact details where reasonably possible.


C. Legal and safety disclosures

We may disclose information when we believe it is reasonably necessary to:


  • comply with applicable law, regulation, legal process, or lawful government request;
  • enforce our terms, policies, and agreements;
  • protect the rights, property, safety, or security of Nightrush, our users, or others; or
  • investigate fraud, harassment, abuse, or security incidents.

D. Business transfers

We may disclose information in connection with an actual or proposed merger, acquisition, financing, asset sale, bankruptcy, or similar transaction, subject to customary confidentiality protections.


E. With your direction or consent

We may disclose information where you instruct us to do so or otherwise consent.


We do not sell your mobile number, SMS consent data, government ID data, background-check information, or payment information to third parties for their own marketing or advertising purposes.


7. Cookies, Analytics, and Similar Technologies

We use cookies, SDKs, local storage, pixels, and similar technologies to:


  • keep users signed in and remember preferences;
  • operate security and fraud-prevention tools;
  • understand usage and improve performance;
  • measure errors, diagnostics, and service quality; and
  • support limited product personalization where permitted by law.

Where required by law, we will request consent before using non-essential cookies or similar technologies. You can control cookies through your browser settings and any cookie preference tools we make available.


8. AI-Assisted Features

If we provide AI-assisted search, matching, recommendations, or support features, we may use the information you submit to operate and improve those features.


We do not use payment card information, government ID images, background-check results, or SMS consent records to train public-facing generative AI models. Please avoid submitting sensitive information in free-text prompts unless it is necessary for the service you are using.


9. Data Retention

We retain personal information only for as long as reasonably necessary for the purposes described in this Privacy Policy, including to provide the Services, maintain security, comply with law, resolve disputes, and enforce agreements.


In general:


  • Account and profile data: retained while your account is active and, unless longer retention is required, deleted or de-identified within a reasonable period after account closure or prolonged inactivity;
  • Booking, payment, tax, and transaction records: retained as long as required for legal, accounting, audit, and dispute-resolution purposes;
  • Verification and safety records: retained only for so long as necessary for safety, compliance, fraud prevention, and legal obligations;
  • Support and communication records: retained for customer support, quality assurance, compliance, and dispute resolution;
  • SMS consent and preference records: retained as necessary to demonstrate consent, honor opt-outs, and comply with applicable rules; and
  • Aggregated or de-identified data: may be retained for longer periods or indefinitely.

Where appropriate, we delete, de-identify, or anonymize data when it is no longer needed.


10. Data Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information from unauthorized access, disclosure, alteration, or destruction. These measures may include encryption in transit, access controls, authentication safeguards, vendor diligence, logging, monitoring, and least-privilege practices.


No method of transmission or storage is completely secure, and we cannot guarantee absolute security.


11. International Data Transfers

Nightrush may store or process personal information in the United States or other countries where we or our service providers operate. Where required by applicable law, we implement appropriate safeguards for cross-border transfers, such as contractual protections or other recognized transfer mechanisms.


12. Your Rights and Choices

Depending on where you live, you may have the right to:


  • access the personal information we hold about you;
  • correct inaccurate or incomplete personal information;
  • request deletion of your personal information, subject to legal exceptions;
  • receive a portable copy of certain personal information;
  • withdraw consent where processing is based on consent;
  • object to or restrict certain processing;
  • opt out of marketing communications;
  • appeal a denial of a privacy request, where applicable; and
  • use an authorized agent where permitted by law.

You may exercise rights by contacting us at privacy@nightrush.ai. We may need to verify your identity before fulfilling your request.


Marketing emails include an unsubscribe mechanism. You may also opt out of push notifications through your device settings and recurring text messages by replying STOP.


13. U.S. State Privacy Disclosures

Residents of certain U.S. states may have additional privacy rights under applicable state laws, such as rights to know, access, correct, delete, obtain a portable copy of, or opt out of certain processing of personal information.


Nightrush does not share mobile information with third parties or affiliates for their marketing or promotional purposes. If applicable law grants you a right to appeal our response to a privacy request, you may do so by replying to our response or contacting us again at privacy@nightrush.ai with the word Appeal in the subject line.


14. Children's Privacy

The Services are intended only for individuals who are at least 18 years old. We do not knowingly collect personal information from children under 18. If we learn that we have collected such information, we will take reasonable steps to delete it.


15. Third-Party Links and Services

The Services may contain links to third-party websites, tools, or services that are not operated by Nightrush. We are not responsible for the privacy, security, or content practices of third parties. We encourage you to review their privacy policies.


16. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. If we make material changes, we will post the updated version on our website and update the effective date above. Where required by law, we will provide additional notice.
